Privacy Statement

1. Outline of this Privacy Statement 

1.1 Delta Insurance New Zealand Limited and Delta International Limited (Delta, we, us and our) is committed to protecting personal information in accordance with the Privacy Act 2020 (Privacy Act) and the Information Privacy Principles set out in the Privacy Act.

1.2 This Privacy Statement explains how and why we collect personal information, how that information is stored, how individuals can access and correct their personal information, and when we may disclose personal information to third parties.

1.3 This Privacy Statement does not limit or exclude any rights that an individual has, or may have, under the Privacy Act and (where applicable) the General Data Protection Regulation 2016/679 (GDPR).

2. Application of this Privacy Statement

2.1 This Privacy Statement applies to all instances in which personal information is collected by us, whether directly from an individual or indirectly from third parties, including insurance brokers, financial advisers, claims service providers, and other parties involved in arranging, administering, or servicing insurance.

2.2 By using the products and/or services offered by Delta (Services), individuals acknowledge that personal information will be collected, used, disclosed, stored, and processed in accordance with this Privacy Statement and applicable privacy laws.

3. Changes to this Privacy Statement

3.1 Delta may change this Privacy Statement at any time by uploading a revised version to its website at www.deltainsurance.co.nz (Website).

3.2 This Privacy Statement applies in the form in effect at the time the Services are used.

4. Collection of Personal Information

4.1 Delta may collect personal information, including:

a) communications with us directly, including via phone or email; and

b) information obtained by or submitted to Delta through the use (or prospective use) of the Services, including information provided via an individual’s insurance broker or financial adviser.

4.2 Delta may supplement the information provided to it with information received from third parties, where permitted by law and for the purposes described in this Privacy Statement.

4.3 Delta does not intentionally collect sensitive personal information such as information relating to race, ethnicity, religious beliefs, sexual orientation, political opinions, genetic or biometric data, except where permitted or required by law or necessary for the provision of the Services.

In limited circumstances, and where permitted or required by law, Delta may collect health or medical information where this is necessary for insurance, claims handling or regulatory purposes.

4.4 Indirect collection of personal information

In many cases, Delta collects personal information indirectly, meaning from someone other than the individual concerned. This may include collection from insurance brokers, financial advisers, claims service providers, loss adjusters, investigators, or other third parties involved in the provision of insurance services.

Where personal information is collected indirectly, Delta takes reasonable steps to ensure that individuals are made aware of:

  • the fact that their personal information has been collected;

  • the purposes of the collection;

  • the types of organisations the information may be shared with; and

  • their rights of access to and correction of their personal information,

including through this Privacy Statement and through notices provided by intermediaries acting on our behalf.

4.5 Agency collecting and holding information

For the purposes of the Privacy Act, Delta is an agency that collects and holds personal information, including where that information is received indirectly from third parties.

5. Personal Information That May Be Collected

5.1 Delta may collect personal information including, but not limited to:

a) name, phone number, residential address, and email address;

b) gender and date of birth;

c) household composition;

d) information about internet-enabled devices;

e) employment history, skills, experience, professional licences and affiliations;

f) educational background;

g) financial information such as bank account details, payment card details, credit history, assets and income;

h) sensitive information in limited circumstances, including criminal record or civil litigation history where relevant to fraud prevention, detection, or investigation;

i) information necessary to provide insurance Services, including details of insured property, policy and claim information, loss history, ownership or management interests, and other insurance held; and

j) marketing preferences and customer feedback.

5.2 If an individual chooses not to provide personal information when requested, Delta may be unable to provide the Services.

6. Use of Personal Information

6.1 Personal information may be used:

a) to verify identity;

b) to provide, administer, or consider the provision of the Services, including disclosure to underwriters and underwriting syndicates;

c) to communicate in relation to the Services;

d) for marketing the Services, including electronic communications;

e) to undertake credit checks where necessary;

f) to invoice and collect amounts owed;

g) to respond to enquiries or complaints;

h) to cooperate with government, industry, or regulatory authorities;

i) to protect or enforce legal rights and interests; or

j) for any other purpose authorised by law.

6.2 Delta may use anonymised data for marketing, analytics, and accounting purposes.

6.3 Individuals may opt out of marketing communications at any time by contacting contactus@deltainsurance.co.nz.

7. Privacy Officer
7.1 Delta shall, at all times, have a person appointed as the “Privacy Officer” (the Privacy Officer).

7.2 The Privacy Officer must be familiar with the provisions of this Privacy Statement and be available to assist on privacy matters for Delta.

8. Cookies

8.1 Delta uses cookies on its Website to monitor usage. Cookies may be disabled via browser settings, although this may affect Website functionality.

9. Disclosure of Personal Information

9.1 Delta will not disclose personal information to third parties unless authorised by the individual, required or permitted by law, or where disclosure relates to the purposes described in this Privacy Statement.

9.2 This may include disclosure to insurance brokers, underwriters, underwriting agencies, reinsurers, claims service providers, and regulatory authorities, as described in this Privacy Statement.

10. Protection and Retention of Personal Information

10.1 Delta will take all reasonable steps to ensure the personal information collected, used or disclosed in accordance with this Privacy Statement is stored in a secure environment protected from unauthorised access, modification or disclosure.

10.2 Delta will hold personal information collected in accordance with this Privacy Statement both before and after the provision of its Services in order to fulfil the purposes for which it was collected, but only for so long as we are legally entitled to do so.

11. Access to and Correction of Personal Information

11.1 Customers have the following rights in relation to their personal information: a) To request access to their personal information. b) To request a correction to their personal information. c) To request the deletion or removal of their personal information. d) To object to the processing of their personal information. e) To request a restriction on the processing of their personal information. f) To request a transfer of their personal information to you or a third party. g) To withdraw consent to the use of their personal information.

12. Data Processing Agreements

12.1 This Privacy Statement may be supplemented or superseded between a Customer and Delta pursuant to the terms of any data processing agreement (or document having similar effect) entered into in writing between the Customer and Delta.

13. Severability

13.1 If any part of this Privacy Statement is found by a court to be invalid, void or unenforceable, whether under the Privacy Act, GDPR or any other applicable law, such provision will be deemed to be deleted from this Privacy Statement and the remaining provisions will continue in full force and effect.
